Mother takes kids across state lines w/o court permission under false pretense to father is this kidnapping?

Can a mother take children, leave state move cross country prior to a final divorce and custody order by the judge, along with using false pretense with father, would it be kiddnapping and who should you contact for help. The court date is not till 30 of the month. she has moved to georgia and is in the army. what should I or can I doMother takes kids across state lines w/o court permission under false pretense to father is this kidnapping?
Well until there is a custody order she isn't kidnapping. It is possible that the courts will force the kids to move back to their original state, but unless she is an abusive parent you'd be putting the kids into the middle of a mess!Mother takes kids across state lines w/o court permission under false pretense to father is this kidnapping?
yes, contact the police and show copy of court order that says when next court date is. if they are not willing to help, which they never are, then tomorrow morning go file a motion for forthwith, which means you will have a sooner court date do to urgency and when you file make sure you write down the specifics. when you go in court ask the judge to order a guardian ad litem, which is a lawyer for the best intrest of the child and also tell the judge the situation and he should order an amber alert.
No if there is no Court order for custody then either parent can go any where they please until this custody is filed and ordered Mean while get down to courts and file papers to rush this order so then she will have to transport back or you may have to go get but only after she receives these papers but still would get in touch with a lawyer and do this all legal
see what kind of motion you can file in court and if this is kidnapping, you can press charges of such due to unresolved divorce issues that are still pending in court, I would seek legal advice as soon as possible, talk with the police
