Can I take my university to court for a wrongful dismissal over false allegation of sexual misconduct?

I have no disciplinary record, am a good student, good employee and have a been a contributing member of their community.Can I take my university to court for a wrongful dismissal over false allegation of sexual misconduct?

Assuming that you have actually been thrown out, that the allegations are no longer in the process of investigation, then yes.





If you still being investigated for sexual misconduct, then there will not be a disciplinary record unless your found guilty.





But they would have to involve the police to prove it, or at least have a way to present proof had it have been taken to court.





I believe that it would be orderly to prove your guilt rather than your innocence to a court which the universities responsibility, or that means you can also take action legally against the courts too and cliam compesantion, which by this piont would be substancial.


Unfounded allegations are always getting people done.

It is my understanding that unfortunately in a case such as yours it is up to you to prove your innocence which sometimes is almost impossible. Also it is most often than not very expensive as far as lawyer fees and court cost. My son was unjustly accused of theft from a former employer to a prospective employer. He has to prove his innocence not the other way around.
Try, even though Feminist Jurisprudence is not in effect in many areas, whereby you could experience discrimination because of gender.





Look at what happened to the Duke guys. Many feminists STILL are in denial and consider them guilty, even though they were victimized.





These sorts of false allegations are growing to epidemic proportions, as reported by one Colorado prosecutor. He could not believe the figures, himself. It's probably almost as bad as the false reporting on Yahoo Answers.

You can take any body to court. However you need the preponderance of the evidence to win. Remember if you fail to win. You may have to pay their legal fees. Sometime fighting for principal takes deep pockets.

Hire a lawyer and they will do all the paper work and phone calls for you. Just make sure you have a solid case before you decide to proceed. Witness statements if any would be beneficial.
